Former Minister of State in the Prime Minister’s Office (Investment), Geofrey Mwambe, has filed a petition at the Kisutu Resident Magistrate’s Court seeking an order for bail or to be brought before the court.
The urgent application, filed by Mwambe’s lawyer, Hekima Mwasipu (reference number 289778 of 2025), names the Inspector General of Police (IGP), the Director of Public Prosecutions (DPP), and the Zonal Crime Officer (ZCO) for Dar es Salaam as respondents.
In the petition, Lawyer Mwasipu said Mwambe has been held at Kigamboni Police Station for over four days without being granted bail or presented in court, contrary to legal requirements.
He urged the court to hear the matter promptly, noting that delays would continue to violate Mwambe’s fundamental rights.
Mwasipu also revealed that Mwambe’s family tried to deliver food to him at the police station from December 7, 2025, but officers denied his presence.
“We have filed this application because Mwambe has been detained for over four days in violation of the law. Police are required to release him on bail if there is no legal reason to detain him beyond 24 hours,” Mwasipu explained.
He added that the law obliges police to seek court approval if detention exceeds 24 hours, a procedure that has not been followed.
“His family is struggling to locate him, and their efforts have been unsuccessful,” the lawyer said.
According to Mwasipu, the arrest relates to allegations of incitement. “He was questioned regarding these allegations but was not granted bail. He was arrested at his home at 8:00 p.m.,” he added.
