The High Court’s Small Claims Division in Dar es Salaam has rejected flash drives and memory cards submitted by opposition leader Tundu Lissu as evidence, stressing the importance of expert verification in court proceedings.
The ruling, delivered by a three-judge panel led by Judge Dustan Nduguru, came after the court determined that a prosecution witness, a Police Inspector, was only qualified in still photography not video analysis making him unfit to authenticate the digital files.
“This decision underlines the court’s commitment to proper legal procedure and expert-based evidence,” said legal analysts following the case.
The court’s insistence on specialized expertise in handling digital evidence sends a strong signal to all parties in ongoing and future cases, emphasizing that technological files must be backed by verified expert testimony to be admissible.
