A dramatic gang rape and
sodomy case that has gripped the nation began its hearing at the Dodoma
Resident Magistrate’s Court on August 20, 2024. The case, No. 23476 of 2024,
involves four accused individuals, including members of the Tanzania People’s
Defence Force (TPDF) and the Prisons Service.
The accused—TPDF officer
MT.140105 Clinton Damas, Prisons Service officer C.1693 Praygod Mushi,
alongside civilians Lord Lema and Nickson Jackson—stand accused of the brutal
gang rape and sodomy of a young woman from Yombo Dovya, Dar es Salaam. The case
has sparked widespread outrage across Tanzania.
As the trial commenced,
Chief Magistrate Zabibu Mpangule presided over the courtroom, marking the
beginning of what promises to be a closely watched legal battle. The defense,
led by Godfrey Wasonga and supported by three other prominent lawyers, pushed
back against the charges.
On Tuesday, the defense
team's lawyer, Meshaki Ngamando, addressed the media outside the court,
confirming that only one prosecution witness was heard due to time constraints.
He emphasized that the trial is proceeding without any objections raised by
either party regarding the conduct of the proceedings.
“This case involves
serious sexual assault charges, and as per legal requirements, the trial is
being conducted in camera,” Ngamando explained. “The public and the press are
not allowed to observe the proceedings to protect the identity of the witnesses
and ensure the integrity of the evidence. We are confident that justice will
prevail, and that it will not only be done but will be seen to be done.”
The trial is set to
continue until Friday, August 23, 2024. The prosecution has lined up five
witnesses, and all eyes are on how the case will unfold. The defense team's
insistence on the case's fairness reflects the high stakes and intense scrutiny
surrounding this trial.
